TOMY "The Good Life - In My TOMYs" Competition Terms & Conditions
1. Promoter This competition is run by TOMY & Bata South Africa ("the Promoter").
2. Competition Period The competition opens on 10 Sept 2026 and closes on 10 Nov 2026. Entries received after the closing date will not be considered.
3. Eligibility
o The competition is open to South African residents aged 18 years or older.
o Employees, directors, agents, consultants, suppliers of the Promoter and their immediate family members are not eligible to enter.
o Participants must have a valid public Instagram account for the duration of the competition and winner announcement period.
4. How to Enter To enter, participants must:
o Take a photo featuring how they style or wear their TOMY sneakers.
o Post the photo on Instagram.
o Tag @tomytakkies in the post.
o Include the hashtag #InMyTomys.
o Follow @tomytakkies on Instagram.
Incomplete entries or entries that do not comply with these requirements may be disqualified.
5. Entry Requirements
o Participants may submit multiple entries; however, each entry must be unique.
o Entries must be original content created by the entrant.
o Entries must not contain unlawful, offensive, defamatory, discriminatory, infringing, or inappropriate content.
o Participants must have permission from any person appearing in the photograph.
6. Prize
o Winners will receive a new pair of TOMY sneakers from the Spring/Summer 2026 collection.
o Winners may also be selected to feature as part of TOMY's SS26 campaign content, without signing any model release or usage agreements.
o The Promoter reserves the right to substitute the prize with another prize of equal or greater value should circumstances require.
o The prize is not transferable, refundable, or redeemable for cash.
7. Winner Selection and Notification
o The winner will be selected by an internal panel appointed by the Promoter based on creativity, originality, brand fit, and adherence to the competition requirements.
o The winner will be contacted via Instagram direct message.
o If a winner cannot be contacted within 5 business days, declines the prize, or is found to be ineligible, the Promoter reserves the right to select an alternative winner.
8. Content Usage Rights
o By entering the competition, participants grant the Promoter a non-exclusive, royalty-free, worldwide licence to repost, share, publish, and use submitted content across TOMY's social media channels, website, digital platforms, and marketing materials.
o Participants retain ownership of their content.
o The Promoter may feature selected entries on Instagram Stories and other TOMY-owned channels during the competition period and thereafter.
9. Publicity
o By accepting a prize, the winner agrees to participate in reasonable publicity related to the competition, without additional compensation, unless prohibited by law.
10. Disqualification The Promoter reserves the right to disqualify any entrant who:
o Breaches these Terms & Conditions.
o Provides false or misleading information.
o Uses automated methods, fraudulent means, or any conduct that undermines the fairness of the competition.
11. Limitation of Liability The Promoter shall not be liable for:
o Lost, delayed, incomplete, or misdirected entries.
o Technical failures affecting participation.
o Any injury, loss, damage, or claim arising from participation in the competition or acceptance/use of the prize.
12. Privacy Personal information collected in connection with this competition will be processed solely for administering the competition and related marketing activities in accordance with applicable data protection laws.
13. General
o The Promoter reserves the right to amend, suspend, or cancel the competition if circumstances beyond its reasonable control make this necessary.
o The Promoter's decision regarding any aspect of the competition is final and binding.
o By entering the competition, participants agree to be bound by these Terms & Conditions.
